THE DE-JUDICIALIZATION OF STRATEGIC LITIGATION: A NEW PERSPECTIVE FOR CLINICAL LEGAL EDUCATION

Resumen

La Educación Legal Clínica desempeña un papel fundamental para garantizar el acceso a la justicia y formación de futuros abogados, utilizando herramientas como el litigio estratégico. Históricamen- te, este litigio ha sido relacionado con la práctica judicial tradi- cional. Es por esto que la desjudicialización del litigio estratégico emerge como una apuesta que desafía las convenciones clásicas de la profesión jurídica. En ese sentido, se pretende demostrar con este artículo la necesidad de utilizar nuevas estrategias de litigio para cumplir los postulados de la educación legal clínica, la protección de los derechos humanos y la consecución de los fines del Estado Social de Derecho, esto a partir de la experiencia del Grupo de Acciones Públicas (GAP).

Esta reflexión cualitativa analiza, en primer lugar, la implemen- tación que el GAP ha hecho sobre seis diferentes estrategias de litigio: judicial, pedagógica, administrativa, mediática, política y social. En segundo lugar, a partir de la conceptualización anterior, se revisa la aplicación de las estrategias en casos paradigmáticos de la Clínica (Iota, Democracia Ambiental, Alpes). Este análisis permite concluir que el litigio estratégico debe tener una mirada integral, que vaya más allá del manejo judicial de los casos, y que permita abordar todas las aristas de la protección a derechos huma- nos y acompañamiento a comunidades. Sin embargo, aún persisten retos en la sociedad, educación y Estado para avanzar hacia un litigio con nuevas perspectivas.

Abstract

Clinical Legal Education plays a fundamental role in ensuring access to justice and training of future lawyers, using tools such as strategic litigation. Historically, this litigation has been related to traditional judicial practice. This is why the de-judicialization of strategic litigation emerges as a challenge to the classical con- ventions of the legal profession. In this sense, the purpose of this article is to demonstrate the need to use new litigation strategies to comply with the postulates of clinical legal education, the pro- tection of human rights and the achievement of the purposes of the Social State of Law, based on the experience of the Public Actions Group (GAP).

This qualitative reflection analyzes, firstly, the implementation that GAP has made on six different litigation strategies: judicial, peda- gogical, administrative, media, political and social. Secondly, ba- sed on the above conceptualization, it reviews the application of the strategies in paradigmatic cases of the Clinic (Iota, Democra- cia Ambiental, Alpes). This analysis leads to the conclusion that strategic litigation should have a comprehensive approach that goes beyond the judicial management of cases, and that allows us to address all aspects of human rights protection and community accompaniment. However, there are still challenges in society, edu- cation and the State to move towards litigation with new approaches.
